Appeals
The Complainant or the Respondent may only appeal the outcome of the decision on one or more of the following grounds:
- Evidence of a conflict of interest;
- Significant error in process;
- The result is patently unreasonable;
- There is significant new evidence that was not available at the time of the decision which has the potential to change the outcome of the matter.
Disagreement with the decision and/or sanction does not constitute grounds for appeal.
Respondents have the right to appeal or grieve decisions or discipline imposed in accordance with the following:
- Non-bargaining unit employees – appeals must be in accordance with the Complaint and appeal procedures in the GUIDE NBU (mun.ca).
- Bargaining unit employees have the right to file a grievance under the terms of the applicable collective agreement.
- Faculty and staff not covered above, shall appeal to the Dean, in writing, within 15 days of notification of the action being taken.
Complainants may appeals, in writing, to the Dean, Faculty of Medicine, within 15 days of notification of the action being taken. The Dean, Faculty of Medicine is bound by all applicable collective agreements and University guidelines.
